Information of Sacramento County Maintenance Districts
Maintenance Areas in Sacramento County are formed for the purpose of providing maintenance on flood control levees when local agencies fail in their responsibilities. The districts are formed under the provisions of Section 12878 of the California Water Code by the State Reclamation Board. The maintenance work is provided by the State Department of Water Resources. The authorized services include levee maintenance, flood patrolling, and emergency repairs. The boundaries of a maintenance area are determined by study. The area within the boundaries of a maintenance area includes the lands which are protected from flooding by the levee. Assessment as part of a Maintenance Area is determined by benefit to each landowner based on assessed valuation of each property and protection afforded.
At the present time, Sacramento County has one flood control Maintenance Area known
as Maintenance Area #9 and is located on the east bank of the Sacramento River between
Sutterville Road and Snodgrass Slough. Maintenance Area #10 and Maintenance Area
#11 have been merged with the American River Flood Control District. Boundaries of
maintenance areas are not necessarily contiguous with reclamation district boundaries.
The State Reclamation Board governs the Maintenance Areas.
In addition to Maintenance Area #9, there are two other agencies providing levee
maintenance and flood control. The American River Flood Control District and the
Brannan-Andrus Levee Maintenance District were formed by special acts of the
legislature to provide service in their respective areas.
Population figures have not been compiled for the Maintenance Areas. Their boundaries
cover the levees they maintain and the immediate land protected by the levee.
Maintenance areas are exempt from Local Agency Formation Commission control. If
landowners wish to reactivate a reclamation district that has been placed within a
Maintenance Area by the State Department of Water Resources, and they are willing to
assume financial and other obligations of levee maintenance, the State will consider their
request. However, if landowners wish to assume financial control and other obligations
for levee maintenance and wish to form a reclamation district, flood control district, or
reorganize one or more of these districts, the district formation/reorganization is a matter
of LAFCo purview and the district formation/reorganization is a LAFCo process.
